The USMCA/CUSMA (successor to NAFTA) preserves a dedicated temporary entry category for citizens of Canada and Mexico working in designated professional occupations — commonly known in the United States as TN status.
Qualifying as a USMCA/CUSMA Professional
To qualify, an applicant generally must show:
- The occupation appears on the USMCA/CUSMA professional occupations list (e.g., accountant, engineer, lawyer, management consultant, scientist, and a range of other listed professions)
- The applicant holds the credential (degree or, where specified, an alternative professional license) required for that occupation
- A pre-arranged professional-level position with a U.S. or Canadian employer, as applicable
- The activity is at a professional level — not simply a trade or unskilled position
Processing
Canadian citizens may typically apply for TN status directly at a land border port of entry or pre-clearance airport, while Mexican citizens generally apply for a TN visa at a U.S. consulate before seeking admission. TN status is granted in increments and may be renewed indefinitely as long as the underlying position and qualifications remain in place.
A Category Without Dual Intent
TN status is a nonimmigrant, temporary category; applicants must be prepared to demonstrate an intention to depart at the end of their authorized stay, which requires careful planning for professionals who may also be pursuing permanent residence.
